PREAMBLE

The use of the site www.stigmi.eu entails the unconditional and automatic acceptance by the User of all these terms of use and legal notices and the commitment to respect them.

Stigmi reserves the right to modify and supplement these provisions at any time without notice and without compensation. The reconnection and the continuous use of the site www.stigmi.eu implies a systematic acceptance of the conditions of use and their respect. Therefore, it is the responsibility of the User to take cognizance of the new updates of these conditions with each new connection to the site www.stigmi.eu.

These terms of use contain exclusions of warranty and limitations of liability which the User declares to have read.

GLOSSARY

The words below, the first letter of which is capitalized, will be defined as follows:

Personal Information: “any information relating to a natural person identified or who can be identified, directly or indirectly, by reference to an identification number or to one or more elements specific to it” (Article 2 of Law No. 78 -17 of January 6, 1978). In the context of the present, these provisions also apply to legal persons. The IP address of the User is in particular a Personal Information.

Additional Personal Information: Name, email address, telephone and physical contact details of the User.

French legislation: All the legislative, regulatory and normative texts in force in France.

User: Internet user, natural or legal person, connecting and / or using the website www.stigmi.eu.

PERSONAL INFORMATION COLLECTED

In France, Personal Information is notably protected by Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article 226-16 of the Penal Code and European Directive No. 95 / 46 / EC of the European Parliament and of the Council of 24 October 1995.

On the occasion of the use of the site www.stigmi.eu, are collected the following information which are not considered as personal (“Non-Personal Information”):
– the Internet address URL of the links through which the User accessed the site www.stigmi.eu
– the access provider of the User.

On the occasion of the use of the site www.stigmi.eu, the Internet Protocol (IP) address of the User is collected the information which is considered as a Personal Information by a part of the jurisprudence and by the CNIL.

Stigmi also collects additional personal information about the User (name, email address, telephone number) for the purposes of the services offered by the site www.stigmi.eu. The User provides such Additional Personal Information in full knowledge of the facts, in particular when he proceeds to enter them himself. It is then specified to the User of the site www.stigmi.eu the obligatory nature or not of the Personal Information which it would have to provide.

The User justifying his identity has the possibility to request from Stigmi, to the email address info@stigmi.eu: – the verification of personal data concerning him having been collected by Stigmi or on his behalf;
– information relating to the purpose of processing these data;
– the information relating to the identity and geographical affiliation of the recipients of these data;
– the communication of a copy of these data delivered free of charge, insofar as such a request is not abusive, in particular by its repetitive and disproportionate nature.

No Personal Information (including Additional Personal Information, if any) of the Site User www.stigmi.eu is:
– collected without the knowledge of the User;
– published without the knowledge of the User;
– exchanged, transferred, assigned or sold on any support to third parties.

Only the assumption of redemption of Stigmi and its rights would allow the transmission of such information to the prospective purchaser who would in turn be given the same obligation to store and modify the data vis-à-vis the Site User www.stigmi.eu. In addition, Stigmi is authorized to carry out studies and statistical analysis on the use and typology of Users of the site www.stigmi.eu, subject to the anonymity of the latter.

MODIFICATION OF PERSONAL INFORMATION COLLECTED

In accordance with the provisions of Article 40 of Law No. 78-17 of 6 January 1978, the User has a right to change the personal data collected about him. To do this, the User sends to Stigmi:

by indicating his name or business name, his physical and / or electronic contact details, as well as, where applicable, the reference he would have as a member of the www.stigmi.eu site. The modification will take place within a reasonable time from the reception of the request of the User.

CNIL DECLARATION

The site www.stigmi.eu collecting additional Personal Information of its Users, it has been the subject of a prior declaration to the CNIL registered under the receipt number 1736045.

COOKIE

A “Cookie” allows the identification of the User, the customization of his consultation of the site www.stigmi.eu and the acceleration of the layout of the site through the recording of a data file on his computer.

The User acknowledges being informed of this practice and authorizes Stigmi to proceed with it.

In any case, Stigmi undertakes never to communicate the content of these “Cookies” to third parties, except in the case of legal requisition.

To do this, the User will proceed to the setting of his browser from the “tool” menu for Microsoft Internet Explorer. ADVERTISING NATURE OF THE CONTENT

Stigmi informs the User if necessary of the advertising nature of the contents of the site www.stigmi.eu.

COPYRIGHT AND INTELLECTUAL PROPERTY

All elements of the site www.stigmi.eu, including texts, presentations, illustrations, photographs, trees and formatting are, except public documents and additional details, the exclusive intellectual property of Stigmi or its partners. As such, their representations, reproductions, interleaves, diffusions and reruns, partial or total, are prohibited in accordance with the provisions of Article L. 122-4 of the Code of Intellectual Property. Anyone proceeding without being able to justify a prior and express authorization of the holder of these rights incurs the penalties relating to the offense of counterfeiting provided for in Articles L. 335-2 and following of the Code of Intellectual Property. In any case, on any authorized copy of all or part of the content of the site, must be marked “Copyright Stigmi all rights reserved”.

APPLICABLE LAW - JURISDICTION

The conditions of use of the site www.stigmi.eu are governed, interpreted and applied under French law. Only French courts will be competent to hear any disputes relating to these Terms of Use and their implementation, including their validity, interpretation, performance, termination and consequences.
